ATV's for Kids

Ok guys and gals...Need some help on this one.

I want to purchase a couple of ATV's for my boys, ages 6 and 8. There seems to be some confusion over the federal law which limits the engine size for the kids. Now I looked at a 50cc and a 70cc and both my boys are to small for the frame size of these. Looking on line there seem to be some kids ATV's wit limiters and safety cutoff equipment. These are up to 110cc with age range of 6-12.

So what is the Federal law? Can I put my boys on these 110cc legally and safely? Has anyone else used these kids ATV's...How are they?

Restrictions are placed on a State by State basis, there is not any federal law that I am aware of. The Consumer Product Safety Commission (CPSC) is trying to get federal laws in place, but as far as I am aware, they have not been successful at the Federal level.

This is the basic rule of thumb by the ATV Safety Institute:
a. Age 6 and older - Under 70cc
b. Age 12 and older - 70cc to 90cc
c. Age 16 and older - Over 90cc

All of the big name manufacturers place safety guideline stickers on the bikes on a voluntary basis. There are some manufacturers that have began selling bikes in the United States that are not part of this voluntary action that do not place these stickers on the bikes.

Many of these "kids" ATV's are off-brand models (many coming from China). The issue that I have seen people experience with them is that aftermarket parts are very difficult to get, and repairs are difficult to do as well because parts are hard to obtain.

If the bike cannot be bought locally, and there is not sure way to get parts for it, I wouldn't touch it unless it was extremely cheap.

As for the legality issue, you need to see if there are any laws in the State that you live in, as well as other States that you would ride in. A third thing to consider is if you ride at certain parks/trails, if they have any specific rules regarding youths on ATVs.

ATV Laws For Virginia

Here are the specific laws for Viriginia.

  • ATVs over 50 cc's and purchased as new on or after July 1, 2006 required to be titled.
  • All ATV riders must wear helmets.
  • No one under 16 may operate an ATV, except that children between the ages of 12 and 16 may operate ATVs of no more than 90 cc's and children less than age 12 may operate ATVs of no more than 70 cc's.
  • No passengers are permitted on an ATV at any time, except if ATV is designed to be operated with a passenger.
  • ATV use on public highways is prohibited, except to cross these roads, for agricultural purposes, or while in Buchanan County.
